2. Возраст и дееспособность

Вам должно быть не менее 13 лет либо больше, если в вашей стране установлен более высокий минимальный возраст, и вы должны иметь право принять эти Условия. Если закон требует согласия родителя или опекуна, пользоваться Bloomwish можно только с таким согласием. Сервис не предназначен для детей младше применимого минимального возраста.

3. Аккаунты и гостевой режим

Можно войти через Apple, Google или email и пароль либо использовать гостевой режим. Вы отвечаете за безопасность доступа к устройству и аккаунту авторизации, достоверность данных профиля и действия через ваш профиль Bloomwish. Если вы подозреваете несанкционированный доступ, сообщите нам как можно скорее.

4. Возможности сервиса

Bloomwish позволяет создавать списки и желания, добавлять фотографии, публиковать список, делиться ссылкой, принимать приглашения и отмечать подарок как зарезервированный. Резерв — только координационная отметка: это не покупка, платёж, договор, обещание доставки или гарантия вручения подарка.

5. Приватные и опубликованные списки

Новые списки приватны по умолчанию. После публикации любой получивший или нашедший ссылку может увидеть опубликованное содержимое. Видимость резерва и имени дарителя определяется настройками списка. Вы сами выбираете, что публиковать и кому передавать ссылку.

6. Ваш контент

Права на названия, тексты, фотографии, ссылки, коллажи и иной добавленный вами контент остаются у вас. Вы предоставляете Argentoom FZE LLC неисключительную, всемирную и безвозмездную лицензию на хранение, копирование, обработку, отображение и передачу контента только в объёме, необходимом для работы, защиты и улучшения запрошенных функций Bloomwish, включая показ опубликованного списка. Лицензия прекращается после удаления контента, кроме разумных резервных копий, обязательного хранения и контента, ранее законно полученного другими лицами.

7. Ваша ответственность

У вас должны быть права и разрешения на загружаемый контент, включая фотографии и сведения о других людях. Не публикуйте пароли, платёжные данные, государственные идентификаторы, сведения о здоровье, точное местоположение и другие чувствительные данные. Вы отвечаете за свой контент и взаимодействие с другими пользователями.

8. Запрещённые действия

• Незаконные, мошеннические, угрожающие, оскорбительные, дискриминационные, непристойные действия и нарушение чужих прав.
• Выдача себя за другое лицо, спам, обманные ссылки, вредоносный код и несанкционированный сбор персональных данных.
• Вмешательство в безопасность или доступность, обход ограничений, автоматизированный сбор данных и чрезмерные запросы.
• Обратная разработка или копирование сервиса, кроме случаев, прямо разрешённых законом.
• Недобросовестное резервирование подарков с целью ввести людей в заблуждение или нарушить работу списка.

9. Сторонние сервисы и ссылки

Bloomwish использует сервисы Apple, Google, Firebase, магазины приложений и хостинг-провайдеров. Желания могут содержать ссылки на сторонние магазины и товары. Их условия, приватность, доступность, цены, контент и сделки контролируют третьи лица. Bloomwish не гарантирует и не одобряет их и не является стороной внешних покупок.

10. Интеллектуальная собственность

Программное обеспечение, дизайн, название, логотип и служебный контент Bloomwish, кроме пользовательского, принадлежат Argentoom FZE LLC или лицензиарам. При соблюдении Условий вам предоставляется ограниченная, отзывная, непередаваемая и неисключительная лицензия для личного некоммерческого использования приложения.

11. Доступность и изменения

Мы стремимся поддерживать Bloomwish, но не обещаем бесперебойную и безошибочную работу. На сервис могут влиять обслуживание, сеть, сторонние сбои, инциденты безопасности и изменения продукта. Мы можем добавлять, менять или прекращать функции и постараемся сообщать о существенных изменениях, когда это уместно.

12. Bloomwish Premium и подписки

В Bloomwish есть бесплатный тариф и необязательная подписка Bloomwish Premium. На iOS месячный и годовой планы приобретаются через Apple. Доступные функции, период оплаты, цена, валюта и условия вводного предложения показываются до подтверждения покупки.

Оплата списывается с Аккаунта Apple при подтверждении покупки или после окончания доступного вам бесплатного пробного периода. Подписка продлевается автоматически, пока вы её не отмените. Пробные периоды и другие предложения зависят от условий доступности и переходят в указанный платный план, если не отменены до продления.

Управление и отмена: Настройки iPhone → ваше имя → Подписки. Чтобы избежать продления пробного периода, отмените его не менее чем за 24 часа до окончания. Оплаченный доступ обычно сохраняется до конца оплаченного периода; Apple может прекратить отменённый пробный период сразу. Удаление Bloomwish или аккаунта Bloomwish не отменяет подписку Apple.

Используйте «Восстановить покупки» в Настройках Bloomwish или на экране Premium с Аккаунтом Apple, использованным для покупки. Восстановление не создаёт подписку и не возобновляет истёкшую. Оплату и запросы на возврат обрабатывает Apple; обязательные права потребителя сохраняются.

В версиях с привязкой Premium связан с конкретным ID аккаунта Bloomwish и покупкой Apple. Для восстановления используйте аккаунт Apple, с которого совершена покупка, и связанный с ней аккаунт Bloomwish. Вход в другой аккаунт Bloomwish не переносит Premium. Старая покупка без привязки связывается при первом успешном явном восстановлении. Если исходный аккаунт удалён или возник спор о привязке, напишите на hello@bloomwish.app; создание нового аккаунта не переносит подписку автоматически.

13. Приостановка и удаление

Вы можете прекратить использование в любой момент и удалить аккаунт через Профиль → Удалить аккаунт. Мы можем удалить контент или ограничить доступ при существенном нарушении, угрозе безопасности, требовании закона, вреде пользователям или злоупотреблении сервисом. Когда это уместно, мы уведомим и дадим возможность устранить нарушение.

14. Отказ от гарантий

Bloomwish предоставляется по мере доступности. В максимально разрешённой законом степени мы не даём подразумеваемых гарантий товарной пригодности, соответствия конкретной цели и ненарушения прав. Мы не гарантируем доступность желания по указанной цене, покупку зарезервированного подарка или ожидаемое поведение другого пользователя. Обязательные гарантии потребителей сохраняются.

15. Ограничение ответственности

В максимально разрешённой законом степени Argentoom FZE LLC не отвечает за косвенные, случайные, специальные, последующие или штрафные убытки, потерю данных, прибыли, возможностей или репутации из-за использования Bloomwish. Ответственность не исключается и не ограничивается там, где это запрещено законом, включая обязательные нормы защиты потребителей.

16. Право, изменения и контакты

Условия регулируются правом Объединённых Арабских Эмиратов без отмены обязательной защиты, доступной вам по закону вашей страны. Споры рассматривают суды по месту регистрации оператора, если обязательный закон не требует иного. Условия могут меняться по юридическим, продуктовым причинам или причинам безопасности; новая дата обозначит существенное обновление. Недействительность одного положения не отменяет остальные. Вопросы и претензии: hello@bloomwish.app. При расхождениях переводов английская версия имеет преимущество в разрешённой законом степени.

1. Agreement and operator

By creating an account, continuing as a guest, or otherwise using Bloomwish, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. Bloomwish is operated by Argentoom FZE LLC in the United Arab Emirates. Questions may be sent to hello@bloomwish.app.

2. Eligibility

You must be at least 13 years old, or the higher minimum age required in your country, and legally able to accept these Terms. If local law requires parental or guardian consent, you may use Bloomwish only with that consent. Bloomwish is not intended for children below the applicable minimum age.

3. Accounts and guests

You may sign in with Apple, Google or email and password, or use the app as a guest. You are responsible for keeping access to your device and authentication account secure, for providing accurate profile information, and for activity performed through your Bloomwish profile. Tell us promptly if you believe your account has been accessed without permission.

4. The service

Bloomwish lets you create wishlists, add wishes and photos, publish a list, share its link, accept shared-list invitations, and indicate that a gift is reserved. A reservation is a coordination signal only: it is not a purchase, payment, contract, delivery promise, or guarantee that a gift will be provided.

5. Private and published lists

New lists are private by default. If you publish and share a list, anyone who receives or obtains the link may view its published content. Reservation and giver-name visibility follow the settings selected for that list. You are responsible for choosing what to publish and for sharing links only with your intended audience.

6. User Content

You retain ownership of the names, text, photos, links, collages, and other content you submit. You grant Argentoom FZE LLC a non-exclusive, worldwide, royalty-free licence to host, copy, process, display, and transmit that content only as needed to operate, secure, improve, and provide the Bloomwish features you request, including sharing a published list. This licence ends when the content is deleted, except for reasonable backups, legal retention, and content already lawfully accessed by others.

7. Your responsibilities

You must have the rights and permissions needed for content you upload, including photos and information about other people. Do not publish passwords, payment details, government identifiers, health information, precise location, or other sensitive personal data. You remain responsible for your content and interactions with other users.

8. Prohibited conduct

• Illegal, fraudulent, threatening, harassing, hateful, obscene, or rights-infringing content or activity.
• Impersonation, spam, deceptive links, malware, or unauthorized collection of personal data.
• Interference with security or availability; probing, bypassing access controls, automated scraping, or excessive requests.
• Reverse engineering or copying the service except where applicable law expressly permits it.
• Using reservations in bad faith to mislead others or disrupt a shared list.

9. Third-party services and links

Bloomwish relies on services such as Apple, Google, Firebase, app stores, and hosting providers. Wishes may contain links to third-party shops or products. Their terms, privacy practices, availability, prices, content, and transactions are controlled by those third parties. Bloomwish does not endorse or guarantee them and is not a party to purchases you make outside the service.

10. Intellectual property

Bloomwish software, design, name, logo, and service content other than user content are owned by Argentoom FZE LLC or its licensors. Subject to these Terms, you receive a limited, revocable, non-transferable, non-exclusive licence to use the app for personal, non-commercial purposes. No other rights are granted.

11. Availability and changes

We aim to keep Bloomwish available but do not promise uninterrupted or error-free operation. Maintenance, network failures, third-party outages, security incidents, or product changes may affect the service. We may add, change, or discontinue features and will use reasonable efforts to communicate material changes when appropriate.

12. Bloomwish Premium and subscriptions

Bloomwish offers a free tier and optional Bloomwish Premium subscriptions. On iOS, monthly and yearly plans are purchased through Apple. Available features, the billing period, price, currency and any introductory offer are shown before you confirm a purchase.

Payment is charged to your Apple Account when you confirm the purchase, or after an eligible free trial ends. Subscriptions renew automatically unless cancelled. Trials and other offers depend on eligibility and convert to the displayed paid plan unless cancelled before renewal.

Manage or cancel in iPhone Settings → your name → Subscriptions. To avoid a trial renewal, cancel at least 24 hours before it ends. Paid access normally continues through the paid period; Apple may end a cancelled trial immediately. Deleting Bloomwish or your Bloomwish account does not cancel an Apple subscription.

Use Restore purchases in Bloomwish Settings or the Premium screen with the Apple Account used for the purchase. Restore does not create a subscription or reactivate an expired one. Apple handles billing and refund requests; applicable consumer rights remain unaffected.

In versions with account binding, Premium is linked to a specific Bloomwish account ID as well as the Apple purchase. Restore with the Apple Account used for the purchase and the Bloomwish account linked to it. Signing into a different Bloomwish account does not transfer Premium. An older purchase without an account link is linked on its first successful explicit restoration. If the original account has been deleted or a link is disputed, contact hello@bloomwish.app; creating a new account does not automatically move the subscription.

13. Suspension, termination, and deletion

You may stop using Bloomwish at any time and may delete your account from Profile → Delete account. We may remove content or suspend access when reasonably necessary to address a material breach, security risk, legal requirement, harm to users, or service abuse. Where appropriate, we will provide notice and an opportunity to remedy the issue.

14. Disclaimers

Bloomwish is provided on an “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that a wish will remain available at a stated price, that a reservation will lead to a purchase, or that another user will act as expected. Mandatory consumer guarantees remain unaffected.

15. Limitation of liability

To the maximum extent permitted by law, Argentoom FZE LLC is not liable for indirect, incidental, special, consequential, or punitive loss, loss of data, profit, opportunity, or goodwill arising from use of Bloomwish. We do not exclude or limit liability where doing so is unlawful, including liability that cannot be excluded under applicable consumer law.

16. Law, changes, and contact

These Terms are governed by the laws of the United Arab Emirates, without overriding mandatory protections available to you in your country. Courts with jurisdiction over the operator’s registered office will have jurisdiction unless mandatory law requires otherwise. We may update these Terms for legal, security, or product reasons; material changes will be identified by a new effective date. If a provision is unenforceable, the remainder continues in effect. Contact hello@bloomwish.app with questions or disputes. In case of translation differences, the English version controls to the extent permitted by law.

2. Conditions d’âge

Vous devez avoir au moins 13 ans, ou l’âge minimum supérieur exigé dans votre pays, et pouvoir légalement accepter ces Conditions. Lorsque la loi exige l’accord d’un parent ou tuteur, Bloomwish ne peut être utilisé qu’avec cet accord. Le service ne vise pas les enfants sous l’âge minimum applicable.

3. Comptes et invités

Vous pouvez vous connecter avec Apple, Google ou une adresse e-mail et un mot de passe, ou utiliser le mode invité. Vous êtes responsable de la sécurité de votre appareil et du compte d’authentification, de l’exactitude du profil et des activités réalisées via votre profil Bloomwish. Prévenez-nous rapidement en cas d’accès non autorisé présumé.

4. Le service

Bloomwish permet de créer des listes et des souhaits, d’ajouter des photos, de publier et partager une liste, d’accepter des invitations et d’indiquer qu’un cadeau est réservé. Une réservation sert uniquement à coordonner : ce n’est ni un achat, ni un paiement, ni un contrat, ni une promesse de livraison ou de cadeau.

5. Listes privées et publiées

Les nouvelles listes sont privées par défaut. Après publication, toute personne qui reçoit ou obtient le lien peut voir le contenu publié. La visibilité des réservations et du nom du donateur dépend des réglages de la liste. Vous choisissez ce que vous publiez et les personnes auxquelles vous transmettez le lien.

6. Votre contenu

Vous conservez vos droits sur les noms, textes, photos, liens, collages et autres contenus soumis. Vous accordez à Argentoom FZE LLC une licence non exclusive, mondiale et gratuite pour héberger, copier, traiter, afficher et transmettre ce contenu uniquement afin d’exploiter, sécuriser, améliorer et fournir les fonctions Bloomwish demandées, notamment le partage d’une liste publiée. La licence prend fin à la suppression, sous réserve des sauvegardes raisonnables, obligations légales et contenus déjà licitement consultés par d’autres.

7. Vos responsabilités

Vous devez disposer des droits et autorisations nécessaires pour tout contenu importé, y compris les photos et informations relatives à autrui. Ne publiez pas de mots de passe, données de paiement, identifiants officiels, données de santé, localisation précise ou autres informations sensibles. Vous êtes responsable de votre contenu et de vos interactions.

8. Usages interdits

• Contenu ou activité illégal, frauduleux, menaçant, harcelant, haineux, obscène ou portant atteinte aux droits d’autrui.
• Usurpation d’identité, spam, liens trompeurs, logiciels malveillants ou collecte non autorisée de données personnelles.
• Atteinte à la sécurité ou disponibilité, contournement des contrôles, extraction automatisée ou requêtes excessives.
• Rétro-ingénierie ou copie du service, sauf autorisation expresse de la loi.
• Réservations de mauvaise foi visant à tromper ou perturber une liste partagée.

9. Services et liens tiers

Bloomwish dépend notamment d’Apple, Google, Firebase, des boutiques d’applications et d’hébergeurs. Les souhaits peuvent contenir des liens vers des boutiques ou produits tiers. Leurs conditions, pratiques, disponibilité, prix, contenus et transactions relèvent de ces tiers. Bloomwish ne les garantit pas et n’est pas partie aux achats externes.

10. Propriété intellectuelle

Le logiciel, le design, le nom, le logo et les contenus de service Bloomwish, hors contenu utilisateur, appartiennent à Argentoom FZE LLC ou à ses concédants. Sous réserve de ces Conditions, une licence limitée, révocable, non transférable et non exclusive vous permet d’utiliser l’app à des fins personnelles et non commerciales.

11. Disponibilité et modifications

Nous cherchons à maintenir Bloomwish disponible sans garantir un fonctionnement continu ou sans erreur. Maintenance, réseau, défaillances de tiers, incidents de sécurité et évolutions peuvent affecter le service. Nous pouvons ajouter, modifier ou retirer des fonctions et nous efforcerons de signaler les changements importants lorsque cela est approprié.

12. Bloomwish Premium et abonnements

Bloomwish propose une formule gratuite et des abonnements Bloomwish Premium facultatifs. Sur iOS, les formules mensuelle et annuelle sont achetées via Apple. Les fonctions, la période de facturation, le prix, la devise et toute offre de lancement sont indiqués avant confirmation.

Le paiement est débité du compte Apple à la confirmation de l’achat ou à la fin d’un essai gratuit éligible. L’abonnement se renouvelle automatiquement jusqu’à son annulation. Les essais et offres dépendent de l’éligibilité et deviennent la formule payante affichée sans annulation avant renouvellement.

Gérez ou annulez dans Réglages iPhone → votre nom → Abonnements. Pour éviter le renouvellement d’un essai, annulez au moins 24 heures avant sa fin. L’accès payé continue normalement jusqu’à la fin de la période payée ; Apple peut interrompre immédiatement un essai annulé. Supprimer Bloomwish ou votre compte Bloomwish n’annule pas l’abonnement Apple.

Utilisez Restaurer les achats dans Réglages de Bloomwish ou sur l’écran Premium avec le compte Apple de l’achat. La restauration ne crée pas d’abonnement et ne réactive pas un abonnement expiré. Apple traite la facturation et les demandes de remboursement ; vos droits impératifs restent applicables.

Dans les versions associant l’abonnement au compte, Premium est lié à un ID de compte Bloomwish précis ainsi qu’à l’achat Apple. Restaurez avec le compte Apple utilisé pour l’achat et le compte Bloomwish associé. Se connecter à un autre compte Bloomwish ne transfère pas Premium. Un ancien achat sans association est lié lors de sa première restauration explicite réussie. Si le compte d’origine a été supprimé ou si l’association est contestée, contactez hello@bloomwish.app ; créer un nouveau compte ne transfère pas automatiquement l’abonnement.

13. Suspension et suppression

Vous pouvez cesser d’utiliser Bloomwish et supprimer votre compte via Profil → Supprimer le compte. Nous pouvons retirer un contenu ou suspendre l’accès en cas de violation importante, risque de sécurité, obligation légale, préjudice aux utilisateurs ou abus. Lorsque cela convient, nous vous informerons et vous permettrons de corriger la situation.

14. Exclusions de garantie

Bloomwish est fourni selon sa disponibilité. Dans les limites légales, nous excluons les garanties implicites de qualité marchande, d’adaptation à un usage particulier et d’absence de contrefaçon. Nous ne garantissons ni la disponibilité ou le prix d’un souhait, ni l’achat d’un cadeau réservé, ni le comportement d’un autre utilisateur. Les garanties impératives des consommateurs restent applicables.

15. Limitation de responsabilité

Dans les limites permises par la loi, Argentoom FZE LLC n’est pas responsable des pertes indirectes, accessoires, spéciales, consécutives ou punitives, ni des pertes de données, bénéfices, opportunités ou réputation liées à Bloomwish. Aucune responsabilité n’est exclue ou limitée lorsque la loi l’interdit, notamment au titre des droits impératifs des consommateurs.

16. Droit, modifications et contact

Ces Conditions relèvent du droit des Émirats arabes unis, sans écarter les protections impératives de votre pays. Les juridictions compétentes du siège de l’opérateur sont compétentes, sauf règle obligatoire contraire. Les Conditions peuvent évoluer pour des raisons légales, de sécurité ou de produit ; une nouvelle date signalera une modification importante. L’invalidité d’une clause n’affecte pas les autres. Questions et litiges : hello@bloomwish.app. En cas d’écart entre traductions, l’anglais prévaut dans les limites légales.
